Scarcely a document of any kind has been here introduced that was ever before published; and where facts, before known, are stated, I have usually done it on the authority of the original evidence to be found among Judge Smith's papers. Many of the letters here given are from the original draughts which he preserved, and will sometimes be found to differ verbally from the copies that were sent. He was in the habit of transferring to his common-place book whatever particularly struck him in his reading, accompanying In extracts often by remarks of his own.
